The Condominium Property Law was created in 2011 in response to the growing development of this type of property in Mexico. It is a great tool for conflict resolution and prevention, as it broadly regulates the relationships between condominium owners and managers. Before the condominium laws in Mexico, for example, collecting maintenance fees was much more complicated, as was enforcing penalties on those who didn’t comply. Managers were not certified, and therefore their work was not regulated.

The rights and obligations of condominium owners were established by the residents themselves, leading to conflicts, as breaches had no legal consequences.

Having a law for condominiums clarifies what it means and implies to live in a community. Each party—residents, administration, staff, assembly, committees, and government authorities—has clear limits and defined tasks. At the same time, rights are established that cannot be overlooked by any party.

Therefore, ensuring compliance requires constant effort, as it is essential that everyone within the condominium knows and, above all, applies it—not just you as the administrator.

Some Recommendations

• Remember that each state in the Republic has its own law. While they are generally very similar, you should be aware of their differences and what applies to your specific location.

• Keep the law handy for easy consultation and stay informed about the latest updates.

• Occasionally, write articles about different aspects of the law and send them to the condominium owners. This way, you inform them simply and reinforce the norms and communication.

• When you start managing a condominium, review the Constitution of the Condominium Property Regime and its registration with the Procuraduría to ensure everything is in order.

• Don’t forget that for the property law in Mexico City, certain repairs within the condominium require prior authorization from the competent authorities.
